I was talking to Jeanne about the Supreme Court and the Law and she suggested I make a posting about what I was seeing and thinking.

You may not realize it, but there has been a new "God" around for about 4000 years.  It's been worshipped in many ways and it by itself can be very cold hearted and abusive.

The name of this "God" that rules most of our planet is called "Law".  It is rooted in human reason and linear thinking.  It has made historic laws such as "Thou shalt only have sex in the missionary position." (I always thought that was a bit too much Government in the Bedroom personally).

This God has decreed at what age we may marry, and that can change depending on geography and has no allowance for the simple fact that the real "Creator of all that is" may have created us with a different timeline.

This God is very powerful, it is created, modified and manipulated by (mainly men).  "Rule of Law" is the foundation of modern society but the very context of "Law" is man made, though it is often attributed as having come from "The Creator". 

The God Law is often cold, ruthless without heart or reason.  Yet, Law can serve it's purpose "if" it's proper contexts and interpretations are applied with a human heart taking into consideration circumstances, motive and the humanity of others.

In a court of Law (The Church of this God), often Judges (the Cardinals of the Church) refer to the rulings of previous cases for judgment.  This makes the assumption that previous rulings were right and just.  Yet we freely acknowledge that as high as 20% of those "in jail" are actually innocent, we just don't know who.

"Of the people, By the people" - what a lot of people do not realize is the LAW in the U.S. was intended to be a law for the "Common man" written in "Common language".  (Man and Women)

Suddenly we have to have lawyers in certain cases and situations and precedents and procedures have to followed (rituals) that are not available to the common man.  Our president created a new legal definitions and terms "enemy non-combatants" which allow for the rights of "Law" to be suspended for these people.  They have no due process.  It is just another example of how those in power use "The God of Law" which is not a god, but is empowered as if it were a God by those in power. 

The law is suppose to be blind, but it is not.  Money often determines the outcome of law and sentencing.  Jury of one's peers, often is no such thing and there is an entire science behind jury selection.

In the State of Oregon, County of Multnomah if you get a traffic citation - you cannot even argue your case before a judge anymore unless you pay the fine first (oops, it's called posting bail).  This creates financial discrimination against those who only have access to the law based upon financial capacity to pay.  A poor person may not even be able to be heard, and can be subjected to abuse by any authority that would "cite" them for a crime or violation.

There are now entire books about "stupid laws" - laugh as we may, at any time, any law that is "on the books" could bite you with the power and authority of "God", at least the Government's version.

My suggestion for the Supreme Court which has periodically demonstrated that Justices can and do fail to do their jobs should have a balanced re-design into 4 equal parts.

There should be a division based upon Gender because men and women view things differently.

There should be a division between "Lawyers" and "Common" The truth is, Lawyers are all trained under a specific school of thought regarding the "Law".  Since the Common man/woman often has to deal with the results of such judgments which have powerful consequences on all of our lives common men and women (who are not blind, and who have heart and are not trained or conditioned to worship the great God call "Law"), and bring reason to the "bench".  I certainly would respect our High Court much more if we add balance and remove "political posturing" and maneuvering.

The "Law" is not perfect, nor infallible and it is time we recognize that.  It has it's place, it is important for our civilization.  Religious special interests and laws that cater to religious doctrines that go against Freedoms of individuals should be removed from all law.  Government and Law should be there to serve the common good of the common people regardless of financial or political capacity/power.

The "Law" should have a human face and human heart and should allow for understanding motives, circumstances, etc.  It should not be cold and ruthless.

It should approach consequences 1st from a context of healing as it's primary focus, and 2nd from a context of punishment, and punishment should be humane.  Locking people up in cages like animals is not humane.  Viewing "prisons" as a growth industry simply reflects depravity of our culture.  We need to revamp many things.
